“On Thursday, I received an e-mail from the general counsel, chief legal officer and corporate secretary of FuboTV, Inc. The letter followed several requests for comment from Jennifer Press, the chief communications officer of FuboTV, in reference to a story I am working on for TheDesk.net.

The e-mail received on Thursday, written by FuboTV’s Chief Legal Officer Gina DiGioia Sheldon, took the form of a cease and desist letter. The letter requested that I stop contacting Ms. Press, and said FuboTV was ‘evaluating what further action we intend to take in connection with your activities aimed at our company and our employees.’ Furthermore, the letter charged potential ‘libel and slander,’ but in follow-up conversations, Ms. Sheldon refused to provide specific examples.

Committing an act of journalism is not unlawful, nor is it inappropriate to ask a company spokesperson if they would like to provide information or comment for a news story. FuboTV’s threat to potentially pursue legal action is nothing more than an intimidation tactic meant to chill my First Amendment right to report the news — one that has been protected time and time again in court (and, specifically, in California through our anti-SLAPP law, which is meant to discourage the type of veiled legal threat that FuboTV and its lawyer made on Thursday).

I’m moving forward with the story, and anticipate publishing it in the future.”
